The long-anticipated announcement about the opening of the 2019 EEO-1 filing season is finally here and it is a SURPRISE!!! EEOC announced today that it will delay the collection of the 2019 EEO-1 reports until March 2021. The 2020 EEO-1 data will be collected at the same time.
An announcement is expected in the Federal Register on May 8th. That document explains that the reason for the delay is due to COVID-19. EEOC is being consistent with other federal reporting delays and actions designed to relieve employers of unnecessary burdens during the COVID-19 crisis. EEOC believes that the delay will help filers provide accurate, valid and reliable data in a timely manner.
The anticipated collection was submitted to Office of Management and Budget (OMB) on March 23, 2020 and approval is pending. Employers will be notified by the EEOC of the date that the EEO-1 survey will open as soon as it is available.
For companies who must file EEO-3 report (Local Union Report) or EEO-5 report (Elementary-Secondary Staff Information Report), the data collection period for the 2020 reports is anticipated to be January 2021. Filers will be notified by the EEOC as soon as the date is available. EEOC will update their website and reach out directly to companies and organizations who must file EEO Surveys.
Berkshire clients are encouraged to continue working with their consultants to complete the 2019 EEO-1 reports now rather than waiting until 2021. This will ease the burden of data collection by companies as they anticipate filing two years of EEO-1 reports when the site opens in 2021.

If Berkshire is preparing your January 1, 2020 affirmative action plan, we recommend using your January 2020 roster for EEO-1 development.
My Plan Date is Between February 1 & June 1
Companies with plan dates between February 1 and June 1 must submit new data for EEO-1 development. If you also have a VETS-4212 project with Berkshire, we recommend using a January 1, 2020 roster to prepare your 2019 EEO-1 and your 2020 VETS-4212.
My Plan Date is Between July 1 & September 1
Companies with plan dates between July 1 and September 1 must submit new data for EEO-1 development. If you also have a VETS-4212 project with Berkshire, we recommend using a January 1, 2020 roster to prepare your 2019 EEO-1 and your 2020 VETS-4212.
My Plan Date is Between October 1 & December 1
Berkshire will develop a 2019 EEO-1 Report using the same roster used to prepare your 2019 affirmative action plan.
If Berkshire is only developing your EEO-1 Report
Berkshire will develop a 2019 EEO-1 Report using data pulled from a snapshot in time between the months of October 1, 2019 and December 31, 2019.

In order for Berkshire to develop your reports, your company must be registered with the EEOC and have a Company Number.
- If this is the first time your company will file an EEO-1 Report, please click here to register your company with the EEOC and obtain a Company Number.
- If your company has experienced a merger, acquisition, or spin-off, please click here for critical information about actions that MUST be completed in advance of filing your company's EEO-1 Reports.
- Be sure your primary EEOC contact person and email address are current. This is the method EEOC uses to contact you with questions ad notifications.
